Judge Throws Out Verdict Against Johnson & Johnson

A judge in California threw out a $417 million verdict against Johnson & Johnson. The company had been sued by a woman who claimed she’d developed ovarian cancer as a result of using talc-based product such as Johnson’s Baby Powder. Judge Maren Nelson granted Johnson & Johnson’s request for a new trial saying that the original trial had errors and “insufficient evidence on both sides.” Additionally, three jurors who had “voted against finding the company liable were improperly excluded from determining damages.” The plaintiff’s attorney promised to file an appeal. Johnson & Johnson is facing 4,800 plaintiffs nationwide in talc-related cases. The company has lost four cases in Missouri with verdicts totaling $307 million.
